3 Decatur Police officers involved in shooting Steve Perkins want wrongful death lawsuit dismissed

A motion filed in federal court seeks the dismissal of a wrongful death lawsuit against three Decatur police officers in the shooting death of Steve Perkins during a repossession of his pickup truck.

The motion filed Thursday on behalf of Christopher Mukadam, Joey Williams and Vance Summer alleges the plaintiffs failed to state a claim upon which relief could be granted.

The three officers, along with officer Mac Marquette, were at Perkins' home on Sept. 29 during the repossession by a tow company.  The lawsuit states the officers concealed themselves and that Marquette identified himself as an officer, ordered Perkins to the ground and immediately shot him.

The filing by Mukadam, Williams and Summers also states they are entitled to qualified immunity.

A federal judge has not yet ruled on the motion.

Marquette is the only officer facing criminal charges related to Perkins' shooting death. He is charged with murder.

Mukadam, Williams and Vance face disciplinary action by the city. They are appealing the mayor's recommended punishment.
